Food allergies are an abnormal immune response to specific food proteins. For a highly allergic individual, consuming even a microscopic trace of an allergen can trigger anaphylaxis—a severe, rapid-onset, and potentially fatal allergic reaction. Because there is no cure for food allergies, the only way consumers can protect themselves is by strictly avoiding the allergen. This makes accurate, comprehensive food labelling not just a regulatory requirement, but a critical life-saving measure.
The Regulatory Landscape in Australia
In Australia and New Zealand, food labelling is governed by the Food Standards Code, specifically Standard 1.2.3 (Information requirements – warning statements, advisory statements and declarations). The regulations regarding allergen declarations are among the strictest in the world, and they have recently undergone significant updates to improve clarity for consumers.
The Mandatory Declarations The Code mandates that the presence of specific allergens must be declared on the label whenever they are present as: – An ingredient – An ingredient of a compound ingredient – A food additive or component of a food additive – A processing aid or component of a processing aid
The “Big 9” (and growing) allergens that must be declared include: 1. Peanuts 2. Tree nuts (must declare the specific nut, e.g., almond, cashew) 3. Milk 4. Eggs 5. Sesame seeds 6. Fish 7. Crustacea 8. Molluscs 9. Soy (Note: Wheat and other gluten-containing cereals, as well as lupin and added sulphites in concentrations of 10mg/kg or more, also have strict declaration requirements).
Plain English Allergen Labelling (PEAL)
To reduce confusion and save lives, the Food Standards Code introduced the Plain English Allergen Labelling (PEAL) requirements. Businesses must now use specific, standardized names for allergens.
For example, you can no longer hide milk behind the term “casein” or “whey.” The label must clearly state “milk.” You cannot just list “tree nuts”; you must specify “macadamia” or “walnut.”
Furthermore, these declarations must appear in two specific places: 1. In the ingredient list, printed in bold font. 2. In a separate allergen summary statement beginning with the word “Contains” (e.g., Contains: Milk, Peanuts, Soy), located immediately next to the ingredient list.
The Danger of Cross-Contact and Vague Labelling
While declaring intentional ingredients is straightforward, the major challenge for manufacturers is managing allergen cross-contact. This occurs when a trace amount of an allergen is unintentionally transferred to a food that is not supposed to contain it (e.g., manufacturing a dairy-free chocolate on the same line previously used for milk chocolate, without adequate cleaning).
Precautionary Allergen Labelling (PAL) When a manufacturer identifies a genuine risk of cross-contact that cannot be eliminated through cleaning and segregation, they may use a Precautionary Allergen Label, such as “May contain traces of peanuts.”
However, PAL must not be used as a substitute for Good Manufacturing Practices (GMP). Overusing “may contain” statements unnecessarily restricts choices for allergic consumers and leads to risk-taking behavior where consumers ignore the warnings. PAL should only be used after a rigorous risk assessment confirms an unavoidable risk.
